Ruby & Sapphies Daycare for Dogs Pty Ltd absolutely cares about the safety and wellbeing of your dog (the Dog). Every effort will be made to ensure your dog’s visit is a safe and happy one. This document constitutes an agreement between Ruby & Sapphies Daycare for Dogs Pty Ltd and the client signing this document (the Client). By signing this document, the Client acknowledges that they have read, understood and agree to be bound by these Terms and Conditions.

1. Parties and Acceptance

These Terms and Conditions form an agreement between Ruby and Sapphies Daycare for Dogs (the Business, we, us or our) and the pet owner or authorised handler signing this document (the Client, you or your). The agreement applies to all daycare services, trial sessions, assessments, transport services if offered, and any related services provided by the Business.

2. Services and Suitability

The Business provides supervised dog daycare in a group social environment. Attendance is subject to availability, suitability, and ongoing compliance with these terms. We reserve the right to require a temperament assessment, trial day, or further review before accepting or continuing any booking. Acceptance into daycare is not a guarantee of ongoing attendance.

3. Eligibility, Health and Vaccination Requirements

You warrant that your dog is in good health, is fit to participate in a group daycare environment, and is free from contagious disease, parasites, infestations, and any condition that may pose a risk to other dogs or staff. You must provide current vaccination records before attendance and keep all required vaccinations current for the entire period your dog attends the Business. As a condition of attendance, all dogs aged over 6 months must be desexed, unless otherwise agreed by the Business in writing, and you must provide satisfactory documentary evidence of desexing upon request or before commencement of services, as required by the Business. You must also ensure your dog is kept up to date with flea, tick and worm prevention. We may refuse entry, isolate a dog, require immediate collection, or suspend attendance if we reasonably believe a dog is unwell, contagious, or otherwise unsuitable to attend.

4. Behaviour, Socialisation and Assessments

You acknowledge that daycare involves interaction with other dogs and staff in an open, supervised environment and that inherent risks exist, including minor scratches, punctures, bruising, illness transmission, stress, behavioural incidents, and, in rare cases, more serious injury. You confirm that your dog has no history of aggression, biting, menacing behaviour, or dangerous tendencies except as fully disclosed by you in writing. You agree to disclose all known behavioural triggers, prior incidents, training issues, anxieties, medical limitations, and any other information relevant to your dog’s care and suitability. We may remove, isolate, or permanently exclude any dog at our discretion where we consider it necessary for safety, welfare, or operational reasons.

5. Owner Disclosures and Ongoing Obligations

You must provide complete and accurate information about your dog and promptly notify us in writing of any change in health, behaviour, ownership, contact details, emergency contact details, medication, reproductive status, or other relevant circumstances. You acknowledge that we rely on the information you provide in deciding whether to accept and care for your dog. You are responsible for any loss, damage, cost or claim arising from inaccurate, incomplete, or outdated information supplied by you.

6. Emergency Veterinary Treatment and Medication Authority

If we reasonably believe your dog requires urgent veterinary attention, first aid, transport, or emergency care, you authorise us to obtain such care without prior notice if you or your emergency contact cannot be reached promptly. You agree that all veterinary, transport, medication, and related expenses are your responsibility and payable on demand. We may administer medication only if agreed in advance and only where clear written instructions and properly labelled medication are supplied by you. We do not guarantee that medication can be administered in every circumstance.

7. Liability, Assumption of Risk and Indemnity

To the maximum extent permitted by law, you acknowledge and accept the inherent risks of dog daycare and agree that your dog attends at your risk. Nothing in this agreement excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or any other applicable law. Subject to those non-excludable rights, the Business is not liable for any indirect, incidental, special, or consequential loss, or for illness, injury, escape, loss, damage, or death arising from events beyond our reasonable control or from the ordinary risks of group dog care. You indemnify and hold harmless the Business, its owners, employees, contractors, and agents against any claim, loss, damage, liability, cost, or expense arising from your dog’s acts or omissions, your breach of this agreement, or your failure to disclose relevant information.

8. Bookings, Fees, Cancellations and Late Collection

Bookings are subject to availability and may require prepayment or a valid payment method on file. Fees are payable at the rates notified by the Business from time to time. We reserve the right to charge cancellation fees, no-show fees, public holiday surcharges, or late collection fees where applicable, provided those charges have been disclosed to you. If your dog is not collected by closing time, we may charge additional care fees and, if necessary, arrange alternative care or transport at your cost.

9. Drop-Off, Collection and Authorised Contacts

Dogs must arrive and depart on lead unless otherwise directed by staff. We may release a dog only to the Client or to a person expressly authorised by the Client. You are responsible for ensuring that all authorised contacts are fit and able to collect the dog safely. If there is any uncertainty about collection authority, welfare, or safety, we may refuse release until appropriate verification is obtained.

10. Privacy and Media Consent

You consent to us collecting, using, storing, and disclosing your personal information and your dog’s information for the purpose of providing services, managing bookings, handling emergencies, processing payments, and complying with legal obligations. You also consent to the Business taking photographs or videos of your dog for care records, safety monitoring, and promotional use, unless you notify us in writing that you do not consent to promotional use.

11. Suspension, Termination and Refusal of Service

You consent to us collecting, using, storing, and disclosing your personal information and your dog’s information for the purpose of providing services, managing bookings, handling emergencies, processing payments, and complying with legal obligations. You also consent to the Business taking photographs or videos of your dog for care records, safety monitoring, and promotional use, unless you notify us in writing that you do not consent to promotional use.

12. Governing Law and General

These Terms and Conditions are governed by the laws of the Australian state or territory in which the Business operates, and the parties submit to the courts of that jurisdiction. If any clause is held to be invalid or unenforceable, the remaining clauses continue in full force. This document may be updated by the Business from time to time, and the current version will apply to future bookings once notified to you.
